It is definitely photoshopped.
A well known Dutch news anchor who is also a pro photographer also thought they where 'shopped but the pics are definitely real after she talked to the guy that took them.
The story is that they where sailing around looking for whales but never thought they would get this close.

The pic of the boat trashed after the mast broke and fell down is definitely real. The one with the whale is not. Can't convince me otherwise. I think they were taken at two different times. I would guess the wreckage was caused by a collision with another boat.

Kinda hard to argue with the video. Maybe the photo was taken off the video and required so much enhancement to make it publishable that it ended up looking fake.
