There seems to be wording in it that prohibits canting rigs, water ballast, and as for the motor, does 32.6(b) apply?

No - those were something drawn up by Alinghi for a consentual match when CNEV was still the official challenger of record (before the courts made GGYC (USA) the official challenger). These matches are falling only under the Deed of Gift that governs the cup trophy (the gift).
In a nutshell, the two parties (challenger and defender) can make the match anything they want to make it as long as they agree. All but one AC match was sailed under agreement (mutual consent)...and that was the 87/88

where the catamaran went up against the monohull. Basically, If they don't or can't agree on any of the details, the Deed of Gift (DoG) provides a simple match consisting of a few limiting factors and three races. It goes into some detail about the races.
It also applies some limits to the boats - 90' length if single masted and 115' if of two masts with a minimum of 40'.
As far as the rules go in the DoG, it's pretty simple there too and it emulates the traditional dual to the death. The challenger picks the weapon and the time, the defender picks the place and the rules. Ahhh, if it were only that easy. Because of the simplistic language in the DoG, expect two more court cases before the Feb. match and at least one more court case afterward.

I keep my ear to the digital ground...it's thumping pretty loud right now. A lot comes from Google news alerts - some from other forums. Webcams on buildings are everywhere and it's amazing how much people are finding out by using them.
Someone at Sailing Anarchy caught USA90 leaving the dock a little bit ago (BMWO has been pretty quiet about their relaunch...not much fanfare).

Well...not quite. First - unless there is mutual consent to have other challengers or defenders, there is only one challenger and defender. Second, there is some debate whether the Deed indicates that the defender's boat should fall within the maximums and rig type of the challenger's challenge. Some say they could build a 115' boat with an itty-bitty second mast (flagpole) to challenge the american's 90' single masted boat - the wording in the Deed seems clear to me that it implies that the boats must be of the same rig type but a significant number of people see it differently...it's a complicated issue and one wrought with emotion. I think what we'll see from both sides are 110 or 115' boats that sit a little bow or stern high in the water and measure 90' on the waterline...maybe. There's still no precise information on how long CZ (A5) or DZ (USA90) is exactly NOR is there any indication from either side that the boats we see today are the ones they will be racing for the cup.
The good old Bait and Switch... hmmmm seems an expensive game to me...

another look. She went again for a long sail over the horizon today. They're doing a lot of weird trimming things probably doing tons of testing and data recording (the boat has dozens of stress sensors laminated into the hull construction all wired back to a central recording station).

Quick update. BMWO filed against Alinghi for contempt of court (2nd time now) for stating that they can change the rules at any time as per their liking and for Alinghi giving the ISAF $209,000, requesting them to delay the formation of the judge panel for the America's Cup (which they did) and hiding the details of whatever agreement the $209,000 went towards.
(remember, this is only the 2nd time an America's Cup has actually happened in absence of any mutual consent and is now under the old language governing the match in the Deed). As for the rules thing, the DoG states:
Alinghi is contending that this wording allows them to change the rules at any time as they see fit as the defending club. BMWO contends that this means the existing club rules are in effect as they existed when the original challenge was filed (2007) and cannot be changed without mutual consent.
As you may already know, Alinghi unveiled a big boat last week. Although that boat has yet to be named their official challenge boat, it's obviously a step towards that direction with only 7 months left to the match. That boat has a gasoline engine bolted to the rear beam powering a hydraulic system that apparently will make the boat control a push-button operation for everything from the sail downhauls, outhauls, daggerboards, to the winches. As of yet, manual grinding stations have yet to show up on their boat and the design appears to be very dependent on the hydraulic control.
The concern by BMWO about the rules is more complex than just the engine but it's a fine example of what position this puts BMWO in. Suppose BMWO steps up and modifies their boat (or one they may be building) with a similar hydraulic system. One day before the race, Alinghi could pull out an existing or new boat withOUT a hydraulic system, change the rules, and disqualify BMWO. Clearly this was not the intent of the Deed of Gift.
The rules issue goes deeper than just the engine, and Alinghi has yet to say that the engine assisted boat is their official AC boat (they don't have to declare their boat until the 1st day of racing in February). While I think the ISAF money thing will probably turn out to be relatively benign, the rumor is that the payment was to affect

to expressly permit the use of power assist and/or ballast systems. Alinghi's club's rules (SNG), when BMWO originally filed their challenge, did not permit power assist or movable ballast. They do now. BMWO built their boat to conform to the 2007 SNG rules...we shall see.
The hearing is scheduled fro July 21 and we should see a relatively quick result.
I hope SNG is removed as trustee and never again allowed to hold the cup. At every juncture, BOR has tried to play by the rules, by the spirit of the deed, only to have SNG tell them
you don't like it, take it to court
. So they did... and everytime SNG has been slapped around by the courts.
FFS how many times does it take for SNG to finally realize that they have to play by the rules?
