David, I don't think they were going upwind. Looking at the tracking replay feature, it appears that they had a dogleg finish after the last gate. I don't see the SIs anywhere, so it's hard to know for sure.
BTW, what a horrific gate rounding. Big pile of boats in no wind. Looked like an Italian boat got manhandled (pushed into the mark with no way out)...

I'm sure the discussion was polite and lively, cause that's how F18 sailors roll.

They have been pretty strict with the 15min after the 1st place finisher rule, so this may stick.
If a finishing window is in the SIs, that becomes a rule and they can't make it optional, and is certainly something you wouldn't change midway through the event (otherwise, Holy Redress, Batman!!!).
EDIT: I may have misunderstood your point. If the first boat didn't finish in the time limit, the race must be abandoned (RRS 35). Naturally, the course could be shortened (code flag S) to avoid this (RRS 32.1(c), assuming the SIs don't prevent shortening the course. Another option is to decrease the length of a leg (code flag C, RRS 33).
